NSW LAND AND ENVIRONMENT COURT HEARINGS TUESDAY 8TH JUNE and WEDNESDAY 9TH JUNE 2010

On Tuesday 8th June hearings will commence on the matter of Roy ‘Dootch’ Kennedy vs Minister for Planning and Stockland Developments Pty Ltd in the Land & Environment Court of NSW. (Proceedings No: 40129 of 2010).

Roy Kennedy, on behalf of the Sandon Point Aboriginal Tent Embassy, is challenging the Planning Minister’s Approval of Stockland’s 181 Lot Residential Subdivision project at Sandon Point, Bulli. Stockland’s Major Project Application (MP 07-0032) was determined by the (then) NSW Planning Minister, Kristina Keneally on 29th November 2009 under Part 3A of Environmental Planning and Assessment Act. 

Mr Kennedy will claim the Minister for Planning did not consider the impacts Stockland’s development project would have on the Sandon Point Aboriginal Place, which was declared under the National Parks and Wildlife Act on 16th February 2007. Mr Alan Oshlack of the Indigenous Justice Advocacy Network will represent Mr Kennedy and SPATE in the Land and Environment Court.
